The course will provide a comprehensive overview of the suits brought against the State under the general language of Section1983, as well as a number of specific statutes including the Americans with Disabilities Act, the Rehabilitation Act and the Religious Land Use and Institutionalized Persons Act, as well as the general defenses to such suits. Sarah Hart, former Director of the National Institute of Justice, will cover the Prison Litigation Reform Act, which was enacted in 1996 with the support of the Attorneys General, to deal with the unique problems posed by frivolous inmate litigation. The nationally-recognized Constitutional scholar Professor Pam Karlan will discuss the various governmental immunities available to the States. The second day will concentrate on a variety of practical nuts and bolts issues faced by state counsel in preparing to defend such cases, and will end with an ethics session dealing with a variety of dilemmas faced by counsel during these cases.

Corrections 101

Fee Requirements

Scholarships are available for the course; they will be awarded on a first-come, first-serve basis. Additional registrants are welcome, but funding will not be available.
