Trenton: New Jersey to Sue E.P.A.
New Jersey yesterday announced its intent to sue the federal Environmental Protection Agency over air pollution from a coal-fired power plant in Pennsylvania. The notice of intent filed by Attorney General Stuart Rabner said that the E.P.A. violated the Clean Air Act by failing to act when the state objected to a permit renewal application.Full Article
H.P. Will Pay $14.5 Million to Settle Suit
SAN FRANCISCO, Dec. 7 — Hewlett-Packard said Thursday that it would pay $14.5 million to settle a lawsuit by the California attorney general over the company’s use of private detectives to obtain private phone records of board members and journalists. The company is paying $650,000 in fines for “statutory damages,” but the bulk of the money, $13.5 million, is going to create a state-administered Privacy and Piracy Fund. The fund is to finance the investigation of consumer privacy violations and of intellectual-property theft, including the copying of movies and music.Full Article
Justices to Weigh Immunity Claims By Underwriters
WASHINGTON -- Adding to a docket already rife with business issues, the Supreme Court agreed to review whether Wall Street underwriters are immune from private antitrust lawsuits and whether a century-old ban on minimum-pricing agreements should stand…. The plaintiffs sued under both federal and state antitrust laws, alleging anticompetitive conduct that if proved could entitle them to treble damages. But the defendant underwriters and purchasers persuaded a federal district judge in New York that Congress had exempted their industry from antitrust laws by enacting separate securities laws overseen by the Securities and Exchange Commission.
