The Department of Law, Office of Special Prosecutions, is recruiting for a full time attorney specialized in the prosecution of cyber-crimes.  This position will prosecute computer aided crimes, primarily including computer aided exploitation of children, criminal use of a computer, and consumer protection.  This is a statewide position where the attorney will have a trial caseload, provide advice and training to local law enforcement and other prosecutors on a statewide level, and may be asked to provide advice to other agencies when issues arise involving computers and criminal law.

The attorney will be expected to develop policies and procedures in cooperation with law enforcement to effectively investigate and prosecute cyber-crimes.  The attorney will assist others prosecuting these crimes with such things as introducing digital evidence at trial, obtaining search warrants for computer devices, and presenting computer forensic experts to a jury.  Applicants must have strong skills as a prosecutor along with strong computer and digital evidence skills.  They must also be able to interact sensitively and effectively with young witnesses who have been sexually exploited. The applicant must be willing to travel throughout the state, including rural areas, to present these cases.

This attorney also serves as a point person for the Department of Law on the issue of Human Trafficking. In this role, the attorney will work with a number of federal and state partners to coordinate the prosecution of sex and labor trafficking in the state. The prosecutor will also work with stakeholders from across the state and from different backgrounds to address trafficking through community involvement, training, and active engagement.  The attorney may be asked to participate in one or more working groups related to Human Trafficking.

Qualifications

The ideal candidate will have significant practical experience working with criminal investigators concerning the preservation of internet-based digital evidence, forensic examination of computers and other digital devices and a clear understanding of internet protocols and on-line file sharing programs.  Additionally, the ideal candidate will be familiar with the current trends in Fifth Amendment precedent throughout the United States concerning the applicability of administrative subpoenas, the limits being applied regarding the search of digital devices, and the various jurisdictional challenges that are faced when prosecuting an internet-based offense.  These topics should be addressed in the applicant’s cover letter.
