The Workers’ Compensation Section investigates, processes and defends claims against departments, agencies and institutions of the State involving workers’ compensation law in the North Carolina Industrial Commission pursuant to N.C.G.S. §97-1 and §97-88.2, the North Carolina General Courts of Justice, and federal trial and appellate courts.

Employees independently prepare for and conduct courtroom and administrative litigation, negotiate settlements of cases, prepare legal opinions on rules and operations of an agency, and resolve complaints or answer inquiries on legal issues from the public. Technical guidance is typically available from section or division heads. Employees may represent the State in criminal appeal cases as assigned. Employees may argue cases before the appellate courts, assist agency officials in drafting proposed legislation or internal rules, and perform related duties as required.

Responsibilities

Representing Workers’ Compensation Cases and the State in Criminal Appeals

This position handles Workers’ compensation cases involving alleged work-related injuries to State employees. In addition to Workers’ compensation matters, this role handles criminal appeals for the State of North Carolina before the North Carolina Court of Appeals and Supreme Court, as assigned by the Attorney General.

Researching and Advising Clients on Risk Management Issues

This position advises clients upon request and on an as-needed basis regarding Workers’ Compensation Law and its interplay with other state benefits, risk management issues, legal procedures and Industrial Commission rules and policy.

Client Education and Outreach

This attorney speaks as needed at staff meetings, seminars and workshops for clients to advise them about the basics of Workers’ Compensation law.

Qualifications

  • Knowledge of case, statutory, civil law and workers’ compensation law.
  • Knowledge of judicial and quasi-judicial procedures and the rules of evidence.
  • Ability to maintain organization, good judgment, accuracy, and timelines.
  • Ability to analyze facts, evidence, and legal instruments.
  • Ability to express conclusions and arguments clearly and logically in oral and written form.
  • Ability to maintain effective working relationships
