The Environmental Division (“Division”) is in the Legal Services Division of the North Carolina Department of Justice, Attorney General’s Office. The Division provides legal representation to the Department of Environmental Quality (DEQ), its component divisions, and the various commissions to which DEQ provides staff support. The Division also advises the Department of Administration in its environmental duties, especially the National Environmental Policy Act and State Environmental Policy Act duties.

This position is part of the Commissions, Coastal, and Administrative Section, representing and advising State agencies such as the Environmental Management Commission and the Coastal Resources Commission. The Section also represents the following Divisions of the Department of Environmental Quality (DEQ): the Division of Coastal Management and the Division of Water Resources, Water Planning Section.

The Section handles most personnel and collections matters from DEQ and administers the Attorney General’s Environmental Enhancement Grants Program. Representation includes all aspects of administrative and civil litigation, legal advice in non-litigation matters, and legal advice to the citizen commissions at regular meetings. The Section prepares and argues criminal appellate cases, responds to inquiries and requests for legal assistance from the General Assembly, the Governor, and other public officials, and responds to public inquiries.

Responsibilities

* Represent the above-referenced entities regarding their enabling legislation, the Open Meetings law, the Public Records Act, and the State Ethics Act, and handle the complex cases that arise under the jurisdiction of these commissions.

* Primary legal contact for the chairmen and members of the represented commissions.

* Functions as lead counsel for DEQ’s Division of Water Resources, Water Planning Section, and represents the Division of Coastal Resources before the Coastal Resources Commission as needed.

* Represents DEQ in personnel cases involving the Department.

* Serves as legal counsel for the North Carolina Board of Registration of Foresters.

* Performs advanced legal work in the above-referenced areas, and the advanced nature of the work is continuous and complex.

Qualifications

Minimum Education and Experience Requirement:

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

KSAs:

  1. Thorough knowledge of environmental case, statutory, regulatory and common law is required, with an additional emphasis on State and federal requirements for the protection of water quality, administrative and criminal law.
  2. Thorough knowledge of judicial and quasi-judicial procedure is necessary.
  3. Ability to conduct civil or criminal litigation in trial and appellate courts.
  4. Ability to interpret and apply laws, constitutions, statutes, regulations, court decisions, legal principles and other precedent.
  5. Ability to recognize significant issues and creatively develop strategy and tactics in case.
