Description: The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (“OAG”) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisors and representatives of the major agencies, various boards, commissions, officials, and institutions of State Government. The OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness.
Responsibilities
The Office of the Attorney General is seeking a candidate to fill the position of Assistant Attorney General (“AAG”) for the Police Training and Standards Commission and the Correctional Training Commission. The Police Training and Standards Commission is independent from the Department of Public Safety and Correctional Services, but functions within its auspices. The Police Training and Standards Commission handles matters such as granting and revoking police officers’ certification, reviewing and establishing standards for police officers’ training, and providing guidance to local jurisdictions on topics such as the Police Officers’ Accountability Act. The Correctional Training Commission functions subject to the authority of the Secretary of Public Safety and Correctional Services and handles matters such as, prescribing standards and curriculum for the training of correctional officers, inspecting correctional training centers, determining whether correctional officers meet certification standards, and consulting with other government units and schools for the benefit of correctional education. The AAG for this vacancy will advise the commissions and work with them to continually revise and update training and certification requirements for correctional and police officers. The AAG would also handle any litigation involving the commissions, including subpoenas and Maryland Public Information Act requests directed to them.
The AAG assigned to these commissions also would assist the Department of Public Safety and Correctional Services with its litigation and other legal issues. In this respect, the AAG primarily will handle federal and state court litigation relating to claims by incarcerated individuals and other persons claiming their rights under State or federal law have been violated (e.g., tort actions or claim arising under 42 U.S.C. § 1983). The size of the Department will also present a dynamic opportunity for the attorney to learn other substantive areas of law and hone the attorney’s legal skills. This may include issues pertaining to such areas as procurement law, Title VII of the Civil Rights Act of 1964, and the Maryland Fair Employment Practices Act. The Department also handles cutting-edge legal issues pertaining to developing transgender law, body worn cameras, civil RICO claims, and equal employment opportunity claims. The AAGs for the Department have opportunities to manage their own cases, handle depositions and trials, and draft and argue motions and memoranda in cases seeking judicial review of agency decisions. The AAGs practice law before the federal trial and appellate courts, State circuit, district and appellate courts, the Office of Administrative Hearings, and other administrative agencies. These opportunities exist in a collegial environment that provides flexibility with knowledgeable support from staff and experienced attorneys.
Qualifications
The ideal candidates will have at least five years’ experience, membership in the Maryland Bar (or the ability to waive in immediately) and the United States District Court for the District of Maryland, and strong analytical and writing skills. Experience in handling matters at both the federal and state levels is preferred.
