The Department of Justice (“DOJ”), Civil Division, Fiscal Integrity and Protection Unit, seeks a Deputy Attorney General (“DAG”) to represent the Department of Finance’s Divisions of Revenue and Accounting. This position will be located in New Castle County.

Responsibilities

Primary duties include:
 
• Representing the Division of Revenue before the Tax Appeal Board (“TAB”), which is a 5-member quasi-judicial tribunal from which taxpayers may seek a redetermination of proposed assessments of tax or the allowance of refunds denied by the Division of Revenue.  The DAG will also handle appeals from TAB decisions.
• Advising the Division of Revenue on issues related to State taxes and providing general legal advice and support to the Director of Revenue and the Director’s leadership team, including handling legal process and assisting with drafting legislation, tax advisories and regulations.
• Serving as general counsel to the Division of Accounting and providing guidance with respect to operational issues, Freedom of Information Act requests, procurement and contracting, and other tasks that may be assigned by the Director of Accounting.
 
The DAG will have other duties related the Department of Finance, as well as handling additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head.

Qualifications

Membership in Delaware Bar is required.  The most qualified candidates have some prior general counsel or litigation experience, and some familiarity with State tax law; however, such expertise and experiences are not required for selection. The DAG should be able to take a proactive approach to assisting its agency clients, therefore a successful candidate should have the ability to work with State agencies to identify potential issues and assist State agencies to address such issues to minimize or avoid future legal action.  The DAG should be able to work independently, meet deadlines, communicate clearly with client agencies, and should have demonstrated legal ability and a thorough knowledge of relevant laws and court rules.
 
The DAG must have a willingness to travel within the State to meet departmental needs and meeting schedules.
