The Tort Claims Section receives, investigates, settles and processes claims against departments, agencies, institutions and employees of the State for money damages based on negligence. It defends legal actions involving tort law in the North Carolina Industrial Commission, the North Carolina General Courts of Justice, and appellate courts. The unit currently consists of 13 attorneys, 1 claims supervisor, 5 investigators, 2 administrative specialists, and 5 paralegals.

This position supervises the attorneys who act as defense counsel for departments, institutions and agencies of the State in legal actions brought pursuant to the Tort Claims Act, G.S. 143-291 et seq; and who defend civil actions for personal injury or property damage brought against State employees.

This position provides legal advice concerning tort liability to departments, agencies, and institutions of the State as well as individual State agents and employees. This includes instructing at educational seminars as well issuing formal and informal opinions.  This position oversees the assignment and management of over 3000 new claims filed annually and is also responsible for selecting, training and counseling the attorneys and investigators assigned to handle tort litigation. This position also litigates cases as necessary. This position will be required to travel both in state and out of state, as needed.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $116,147 to $141,535. Salary offers for the selected candidate are based on the candidate’s education and experience related to the position, as well as our agency budget and equity.

The salary grade for this position is LG10. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position.  Please detail ALL work history including non-state service experience.  If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Qualifications

Knowledge, Skills and Abilities / Competencies

  • Thorough knowledge of case, statutory, regulatory, common law, and judicial and quasi-judicial procedures.
  • Ability to conduct complex civil or criminal litigation.
  • Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, court decisions, legal principles, and other legal precedents.
  • Ability to express conclusions and arguments clearly and logically in oral and written form.
  • Minimum Education and Experience Requirements

    Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.

    Management preferences:  Management prefers the following: Tort Claims experience, Civil litigation experience, Industrial Commission experience, NCDOJ experience, commitment to public service, management experience or wish to learn management skillset; and ability to multi-task and prioritize deadlines effectively.
    Ability to recognize significant issues in cases. Ability to analyze complex legal problems and render formal opinions.  Ability to establish and maintain effective working relationships. Ability to creatively develop case strategy and tactics. Ability to manage legal staff.
