Second Circuit Rules in Closely-Watched Multi-State Action against Power Companies

On Sept. 21, a panel of the Second Circuit said the District Court should decide the merits of a suit brought by eight states, the City of New York, and three land trusts against five of the nation�s fossil-fuel power plants for injuries the plaintiffs allegedly suffered and will continue to suffer due to global warming.
