Case Description

Suit challenged the enforcement of a Connecticut statute as a violation of the Commerce Clause of the Constitution. The statute required all milk producers that sold milk in Connecticut to register and pay a $25 registration fee to the Connecticut Department of Agriculture. Out of state milk producers faced prohibition of their milk shipments for failing to comply with the statute while Connecticut milk producers were only subject to a fine. The suit was dismissed in federal court on the grounds that the Supreme Court had original jurisdiction in a suit between two states. New York filed notice of appeal but before the appeal went forward, the Connecticut State Legislature repealed the challenged statute, and the appeal was withdrawn.
