This four-session program is intended to enhance the participant’s knowledge and skills in a constructive and positive learning environment facilitated by experienced attorneys serving as faculty. While the course will discuss investigation and litigation issues, this is NOT a trial advocacy course in the strict sense of the term. Rather, it is designed to expose the participants to the wide and varied issues they will encounter when working on charity investigations, lawsuits, settlements and addressing charity governance concerns. Attendance is open to Association members and NASCO members.

Topics

• An introduction to charity and trust law and attorney general authority.
• Investigative skills including use of the federal IRS Form 990 and civil investigative demands.
• Governance issues and the use of “responsive regulation” to address governance concerns.
• Commonly occurring litigation issues, case resolution, UPMIFA.
• Legal ethics for charity regulators.
