Case Description
Texas brought a lawsuit against Epic Systems Corporation, which sells electronic health record (“EHR”) database software and related applications to health care providers, in December 2025. The complaint alleges that Epic Systems has engaged in monopolistic conduct by preventing challenges to its EHR business in violations of the Texas Free Enterprise and Antitrust Act. The complaint states that Epic System’s databases house more than 325 patient records, which, all together, represent more than 90% of all United States citizens. The complaint alleges that Epic Systems engaged in a number of anticompetitive actions, including delaying or denying access to the EHR it holds to competing firms; preventing customers from switching to competing applications by imposing penalty fees on its customers; and restraining employment opportunities of its current and former employees by entering into agreements with other employers. The complaint also alleges that Epic Systems engaged in false, misleading and deceptive conduct that violated the Texas Deceptive Trade Practices Act by preconfiguring EHR software sold to Texas-based providers to remove parental access to their minor children’s records accompanied by recommendations.
