The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (OAG) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisors and representatives of the major agencies, various boards, commissions, officials, and institutions of State Government. The OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness.
We are seeking a skilled and highly motivated transactional attorney to serve as an Assistant Attorney General to the Maryland Department of Transportation (“MDOT”). MDOT attorneys provide legal counsel and strategic advice on complex transactional and operational matters involving major transportation projects and initiatives.
The ideal candidate will have experience with complex commercial, governmental, or infrastructure-related transactions, including contracts, procurement, public finance, grants, real estate, public-private partnerships, and minority and disadvantaged business enterprise programs. The successful candidate will be comfortable advising senior agency officials, structuring and negotiating agreements, and helping clients achieve operational objectives while managing legal risk. This position presents a unique opportunity to advise one of Maryland’s largest agencies on high-profile transportation projects and transactions that directly affect the State’s infrastructure and economic development.
Principal Duties and Responsibilities:
1. Draft and Negotiate Complex Agreements
Prepare, review, negotiate, and advise on a wide range of transactional documents, including procurement contracts, grants, memoranda of understanding, interagency agreements, real estate instruments, leases, and other agreements supporting major transportation projects and initiatives.
2. Advise Agency Leadership on Business and Operational Matters
Provide strategic legal counsel to agency executives and program leaders regarding complex transactions, project development, business operations, statutory authority, risk allocation, and regulatory compliance.
3. Support Major Procurements and Infrastructure Projects
Advise client agencies throughout the procurement process, including solicitation development, evaluation matters, contract formation, procurement protests, and contract administration issues.
4. Provide Legislative and Regulatory Counsel
Review and advise on proposed legislation, regulations, and policy initiatives affecting MDOT programs and operations.
While the primary focus of the position is transactional and advisory work, the Assistant Attorney General may, as needed, provide legal support in other areas affecting MDOT operations, including ethics, Public Information Act matters, administrative or judicial proceedings, and other agency legal matters. The team consists of a Principal Counsel, one Deputy Principal Counsel, three Assistant Attorneys General, and two office support staff.
