Case Description

As part of a negotiated settlement, the State of Florida sought to permanently enjoin GTE Florida Incorporated (GTE) from continuing its sales tactics concerning its ‘Lineskeeper Inside Wire Maintenance’ service. The state alleged that once the service became optional, GTE would automatically enroll customers unless they notified GTE that they did not want the service, hence constituting an illegal tying arrangement. In order to dispose of these charges without further litigation, the parties entered a settlement in which GTE agreed to take affirmative measures in a clear and understandable manner to ensure customers became aware that the Inside Wire Maintenance Service was an optional service and not required for basic telephone service. Additionally, GTE agreed to pay the State of Florida $25,000 for investigative costs and attorney’s fees.
