The Federal Trade Commission and Plaintiff states sued to enjoin the acquisition of Triton Coal Company, LLC by Arch Coal. The Plaintiffs alleged this acquisition would significantly lessen competition in coal production in the Permian Basin. The Court denied Plaintiffs request for a Preliminary Injunction.
