Case Description

New York v. Julius Nasso Concrete Corp.: This civil litigation challenged and sought remedies for a bid rigging and market allocation among concrete contractors performing contracts over $2,000,000 in Manhattan. The vast majority of the claims were settled before trial and are included in this database under New York v. Cedar Park Concrete Corp. In 1998, a judge refused after a seven day trial to award damages to New York for the rigging of the concrete construction work at the Javits Convention Center. In January 2000, New York persuaded the Second Circuit to reverse and remand for a new trial, holding that the standard for proving damages that the trial judge applied was too stringent. New York v.
