Plaintiff States alleged that Playmobil violated state and federal antitrust laws by conspiring with its dealers to fix prices of Playmobil’s products. Playmobil allegedly induced dealers to comply with its suggested retail price points by threatening to sell its products to competitive stores in the dealers area and refusing to sell to its dealers until they agreed to comply. In response, many dealers complied with Playmobil’s pricing policy, thus establishing a conspiracy. Playmobil agreed to settlement terms with the Plaintiff States. As part of the settlement, Playmobil was enjoined from attempting to fix or maintain prices for which dealers were permitted to sell its products. Additionally, Playmobil agreed to a settlement sum of $275,000 in investigative costs and attorneys fees. The Department of Justice also participated in the investigation.
