Case Description
A large regional chain of supermarkets in the San Joaquin Valley sought to acquire ten (10) Lucky Supermarkets from American Stores. Resolved by settlement under which Save Mart was required to attempt to find a new operator for a supermarket in Merced, with short time running on lease. Failing to find a new lessee, it was required to return to site to the landlord at the conclusion of the lease. It was also required to get prior approval for the acquisition of any new supermarkets in the City of Madera.
