Case Description

The U.S. Department of Justice (DOJ) and Plaintiff States sought to enjoin USA Waste Services, Inc. and Waste Management, Inc. from consummating a merger which they alleged would substantially reduce competition in the waste disposal and commercial waste hauling businesses in their States. USA Waste and WMI agreed to settlement terms with the DOJ and the States. In exchange for consummating their merger, the companies agreed to divest certain waste disposal and waste hauling assets within the Plaintiff States to ensure that one or more viable competitors remained in the relevant markets, and further agreed to provide notice for a 5-year period to individual states of future acquisitions of local competitors.”
