Case Description

According to the state, beginning in August 1985, defendants Alvey (as an auto body shop owner and as the President of the Northern Utah Body Shop Association), Baur and others, engaged in a conspiracy to set uniform auto body labor rates, the number of hours that would be charged for certain auto body work, and agreed to boycott those shops who would not join in the agreement. Without admitting any liability, defendants agreed to be enjoined from any contract, agreement or understanding that would tend to restrict trade, fix prices, or boycott any other auto body shop. Defendants Alvey and Baur were assessed $158,500 in civil penalties, of which $150,000 was suspended. Other co-conspirators were assessed civil penalties in amounts varying from $1,750 to $3000, each with $50,000 suspended pending complainace with individual consent decrees, and ordered to change their business practices.
