The Office of the New York State Attorney General (OAG) is seeking an experienced litigator to serve as an Assistant Attorney General in the Civil Recoveries Bureau’s Bankruptcy Unit, in Albany. The Bankruptcy Unit is responsible for handling bankruptcy matters referred by state agencies that are venued in the Northern, Western, and Southern (Poughkeepsie) Districts of New York, as well as all other federal judicial districts across the country. The unit also represents OAG in bankruptcy proceedings and provides guidance and counsel on bankruptcy-related issues to other bureaus within the office.

 

In addition to pursuing recovery of claims filed in bankruptcy cases, the unit defends actions and proceedings brought in Bankruptcy Courts by debtors, trustees, and other parties against state agencies. These include claim objections, motions for violations of the automatic stay and the discharge injunction, actions to recover preferential payments, and dischargeability issues.

 

Applicants for this position must have a minimum of five (5) years of experience along with excellent legal analysis and writing skills, and experience handling all phases of consumer and commercial bankruptcy litigation.

 

Applicants must reside in (or intend to soon become a resident of) New York state and be admitted to practice law in New York state. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
