Case Description

Michigan brought a complaint against BP, Shell, Chevron, Exxon and the American Petroleum Institute in January 2026.  The complaint alleges that the defendants conspired to stall competition to their fossil fuel business from renewable energy and maintain their dominance in the energy market.  The complaint alleges that the defendants engaged in conduct including abandoning renewable energy products, using patent litigation to hinder rivals, suppressing information concerning the hidden costs of fossil fuels and the viability of alternatives, and using trade associations to coordinate efforts to divert capital expenditures away from renewable energy.  The complaint brings claims under Section 1 of the Sherman Act and Section 2 of the Michigan Antitrust Reform Act.
