Assistant Attorney General – Antitrust Unit

The Consumer Protection Section, Antitrust Unit is seeking an experienced attorney to join a hardworking and creative team of professionals protecting competition in Colorado. This is a great opportunity for attorneys who are passionate about antitrust law, merger review, and litigation. The Antitrust Unit investigates and enforces violations of the Colorado Antitrust Act, the Colorado Consumer Protection Act, and federal antitrust laws. In addition to joining an energetic team, this is a unique opportunity to work on high-profile cases for a nationally-recognized leader in antitrust and consumer protection law—Colorado Attorney General Phil Weiser.

The Antitrust Unit conducts investigations, both local and with other state and federal law enforcement agencies, under the antitrust and consumer protection statutes. Following an investigation, the Unit either works to resolve matters through settlement or brings enforcement actions in state and federal district courts. An Assistant Attorney General in the Antitrust Unit is expected to handle a caseload and to be able to independently conduct investigations and enforcement actions while supervising paralegals and staff. Although the Antitrust Unit seeks self-driven and motivated applicants, the individuals who will succeed in the position are team players and enjoy collaborating with their colleagues to achieve the best results for Colorado consumers.

WHAT YOU WILL DO

The Assistant Attorney General in the Antitrust Unit is expected to handle a caseload and to be able to conduct investigations and enforcement actions both independently and in partnership with other AAGs and support staff. As the attorney assigned to a case, you will be responsible for creating and executing investigation plans, analyzing potential violations of the antitrust laws, negotiating settlements, and litigating cases in both state and federal court. You will also oversee the work of paralegals, investigators, and other administrative personnel partnering on the case, and will frequently collaborate with other local, state, and federal agencies, as well as with other AAGs around the country. Our cases very greatly in size and complexity, and often involve extensive pre-filing investigations. The attorney in this position will be expected to successfully manage that full range of complexity. This attorney will also regularly interact with colleagues, members of the public, law enforcement, and fellow governmental agencies regarding the work of the Unit and create and deliver training to these entities when needed.

The Assistant Attorney General is also expected to regularly evaluate and investigate filings made pursuant to Senate Bill 25-126, Colorado’s Premerger Notification Act. Experience reviewing such filings for an enforcement agency is required at the Senior level.

  • Develop Colorado’s procedures and processes for reviewing premerger filings.
  • Litigate complex civil cases involving violations of the Antitrust laws and other state and federal consumer protection laws at all phases of litigation, including merger review, investigation, discovery, motions practice, trial, appeal, and settlement.
  • Manage nationwide and local litigation to promote Colorado’s efficient and impactful participation in antitrust and consumer protection cases throughout the United States.
  • Participate in complex multi-state investigations, negotiations, and litigation on behalf of Colorado; 
  • Research federal and state laws relating to our consumer protection claims to ensure that our investigations and litigation maintain a strong legal footing; 
  • Travel (both within Colorado and nationwide) when needed for investigations, court appearances, hearings, and trials. 
  • Work alongside management to identify Unit training needs and improve structures and processes in the unit. 

In addition, the role of Senior Assistant Attorney General will be expected to: 

  • Serve as a team lead for both investigations and litigation, overseeing other attorneys, investigators, paralegals, and others, while providing mentoring, coaching, and professional growth opportunities to those on your team; 
  • Serve as a mentor and resource to junior attorneys in the unit, including, for example, providing guidance on investigation or litigation strategy and reviewing certain types of work product, including court filings in state or federal court.

WHAT WE ARE LOOKING FOR

Applicants must be admitted to the Colorado bar or be clearly eligible to waive into the Colorado Bar and be in good standing at the time of application. Candidates eligible to waive into the Colorado Bar will be required to submit proof of their completed application and application for Practice Pending Admission before the first day of employment. The Antitrust Unit is seeking an attorney with a strong interest or background in Antitrust law. This is a generalist antitrust position that includes responsibilities for HSR review, conduct investigations, and all facets of antitrust litigation – the ideal candidate will have a passion for learning new subject areas and industries. Although the Antitrust Unit seeks self-driven and motivated applicants, the individuals who will succeed in the position are team players and enjoy collaborating with their colleagues, including colleagues from other state and federal government agencies, to achieve the best results for Colorado workers, businesses, and consumers.

Ideal candidates will have some, or all, of the following skills and attributes:

  • Background in antitrust and consumer protection law, with ideally four or more years’ experience in antitrust investigations and litigation, including HSR review;
  • Strong complex litigation experience in both federal and state court and the ability to effectively handle all aspects of litigation;
  • Experience leading investigations;
  • Excellent analytical skills and the ability to work on complex issues;
  • Strong research and writing skills and a keen attention to detail;
  • Ability to creatively solve problems through developing practical and imaginative solutions;
  • Experience negotiating settlements and working with opposing counsel;
  • Ability to resiliently handle stress and demonstrate flexibility with changing circumstances;
  • Effective and responsive communication skills;
  • Ability to independently manage a full workload;
  • Be passionate and enthusiastic about having a career in antitrust and consumer protection law and working on behalf of Colorado consumers and agencies.

In order to be considered for a Senior Assistant Attorney General, candidates must have a minimum of ten years of Antitrust experience as a practicing attorney with at least three years of HSR experience. The Senior Assistant Attorney General in the Consumer Antitrust Unit is expected to handle a full caseload and to lead investigations and enforcement actions while serving as a mentor to junior attorneys in the unit.

For the Senior Assistant Attorney General position, we are seeking applicants who have the above qualifications, plus:

  • A minimum of ten years of Antitrust experience as a practicing attorney  
  • At least three years HSR experience
  • Strong organizational skills with a demonstrated ability to manage multiple cases in various stages of litigation.
  • Strong litigation, analytical, research, and oral and written communication skills. 
  • Strong negotiation skills.
  • Excellent interpersonal and client relationship skills.
  • Experiencing mentoring others or leading trial teams in complex federal litigation. 
  • A demonstrated ability to work collaboratively.
  • Maturity and judgment when dealing with high-level stakeholders, including knowing when to consult teammates and supervisors.
  • The ability to be a self-starter who is capable of and enjoys working independently.
  • A demonstrated commitment to diversity, equity, inclusion, and public service.
