The White Collar and Commercial Enforcement Division of the Utah Attorney General’s Office has an immediate opening for a full-time attorney enforcing laws related to consumer protection, securities, real estate, and professional licensing. Our Division represents the Department of Commerce in civil actions before state and federal courts as well as in administrative proceedings before boards, commissions, and administrative law judges. Our attorneys work closely with its client agencies within the Department of Commerce—the Divisions of Consumer Protection, Securities, Real Estate, and of Professional Licensing—in developing cases and executing litigation strategies.

The Division’s mission is to make Utah’s marketplace safe and healthy by combating unlawful commercial activities and building trust in our economic landscape. We are committed to serving the public, and we work collaboratively with our client agencies to protect Utah from deceptive, unprofessional, and unlicensed activities. Our team is on the front line of Utah’s litigation over the opioid crisis, investigation of social media companies, action against pyramid and Ponzi schemes, enforcement of professional standards, and oversight of other commercial activities.

We are looking for applicants with strong legal writing and oral communication skills, trial experience, and a commitment to public service to join our team and immediately take over an existing caseload.

Responsibilities

Example of Duties

Independently prepare and litigate civil and administrative cases from start to finish.
Assess and execute litigation strategy, deciding the appropriate forum, whether and what motions to file, whether or when to settle, which legal arguments to make, and how to most effectively present a case to the trier of fact.
Draft all types of pleadings and litigation documents.
Manage discovery issues involved in complex cases, including numerous depositions, preservation issues, and expert discovery.
Perform thorough legal research and present analyses in clear and persuasive written advocacy and oral argument.
Build and maintain strong client relationships, working collaboratively with Department of Commerce investigators, regulators, and administrators to enforce the rule of law and strengthen trust in Utah’s economy and commercial activities.
Communicate professionally and effectively with clients, opposing counsel, and other stakeholders.
Infrequent travel to various court locations and stay overnight in and outside of Utah.

Qualifications

Ability to independently litigate a case from start to finish.
Excellent legal research and writing skills.
Firm understanding of civil procedural and evidentiary rules.
Commitment to meeting the highest work-product, professionalism, and ethical standards.
Knowledge of modern technology in the practice of law.
Desire to protect and serve the public.
A Juris Doctorate is required.
Preference will be given to candidates with over five years of relevant post-law school experience.
