Are you interested in protecting California’s vulnerable adults? Do you want to help stop abuse and neglect in nursing homes? Join a multidisciplinary team of attorneys, nurses, and special agents working together to prosecute elder and dependent adult abuse in California.
Within the Office of the Attorney General, the Division of Medi-Cal Fraud and Elder Abuse (DMFEA) works to investigate and prosecute fraud against the Medi-Cal program and abuse and neglect within California’s long-term care facilities. Within DMFEA, the Facilities Enforcement Team (FET) Criminal Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other facilities by investigating and prosecuting allegations of abuse and neglect.

Typical duties of the FET Criminal Team Deputy Attorney General include:

  • Working collaboratively with a multi-disciplinary team of attorneys, special agents, nurses, auditors, and legal staff to investigate abuse and neglect referrals and complaints.
  • Advising on the development of investigative plans, including reviewing warrants and interview strategy, and working with expert witnesses under a vertical prosecution model.
  • Evaluating evidence and potential theories of culpability for a filing decision.
  • Prosecuting criminal elder abuse cases in state court at all stages of litigation, including charging, motion work, settlement or jury trial, and sentencing.
  • Assist with unannounced inspections of nursing home facilities as part of the Operation SAFE program.
  • Participate in training and public/law enforcement outreach.
This position will be responsible for cases throughout Southern California and may require travel. Applicants must demonstrate good judgement and professionalism in all interactions with members of the public, colleagues, opposing counsel, and the judiciary. Criminal jury trial experience and familiarity with felony prosecution is preferred.

Desired Qualifications:

In addition to evaluating each candidate’s relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
  • Applicants should demonstrate excellence in legal analysis, oral communication, research skills, and written work product such as memos and motions.
  • Felony criminal jury trial experience is preferred.
  • Experience working with medical records and/or experience working in the healthcare industry, elder law, or medical malpractice, or in a criminal elder abuse prosecution unit is helpful but not required.
  • Ideal applicants are mission driven, organized, meet deadlines, work well with peers and supervisors, take initiative, and have enthusiasm for the work.
