The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (OAG) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisors and representatives of the major agencies, various boards, commissions, officials, and institutions of State Government. The OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness. 

The OAG is seeking an experienced and highly skilled litigator to join its Contract Litigation Unit within the Civil Litigation Division as a Senior Assistant Attorney General. This position involves handling factually and legally complex disputes arising from the formation, administration, and performance of State construction and service contracts. 

The Contract Litigation Unit is primarily responsible for representing the Maryland Departments of General Services and Transportation, the University of Maryland System, and Morgan State University in litigation arising out of State contracts. The Unit represents these agencies before the Maryland State Board of Contract Appeals and in Maryland’s circuit and appellate courts in disputes concerning both the formation of State contracts (including bid protests) and contract performance. Its responsibilities also include defending against contractor claims as well as affirmatively pursuing claims on behalf of the State. The Unit also assists other State agencies, and its attorneys regularly consult with other State lawyers regarding issues arising under Maryland’s General Procurement Law. The Contract Litigation Unit is led by the Unit Chief and Deputy Unit Chief and consists of 11 attorneys and four support staff. 

The Senior Assistant Attorney General will be responsible for all phases of complex litigation, including legal research and motion practice, written discovery, conducting and defending depositions, trial preparation, and oral advocacy. The position also involves providing strategic legal advice on contract and procurement issues to a wide range of State agencies. Sound judgment is required, including the ability to assess risk and determine when settlement may be appropriate. 

In addition, the Senior Assistant Attorney General will mentor, supervise, and/or manage other Assistant Attorneys General within the Unit and may be called upon by the Unit Chief or Deputy Unit Chief to assist with special projects or matters involving novel or complex legal issues. 

Attorneys in the Contract Litigation Unit routinely participate in learning groups, special initiatives, and continuing legal education programs sponsored by the Office of the Attorney General. This position offers the opportunity to handle significant civil litigation in a collaborative and collegial work environment. 

Qualifications

The ideal candidates will have a minimum of six years of progressively responsible litigation experience, including a minimum of one year of supervisory experience. Other minimum requirements include Maryland Bar membership (or eligibility to waive in); first chair deposition experience with fact and expert witnesses; first chair trial experience; strong mentoring abilities; and strong analytical, writing and advocacy skills. Experience in construction or procurement law is strongly preferred, and knowledge of e-discovery platforms are helpful.
