Salary: $79,508 – $135,154 (commensurate with experience per
State of Delaware Deputy Attorney General pay scale)

This is a Temporary 12-month Appointment, with the potential for an extension subject to mutual agreement and available funding.

Job Responsibilities and Duties:  Progressive State Leaders Committee is seeking to hire an attorney to serve, via secondment agreement, as a Special Deputy Attorney General in the Office of Impact Litigation for the Delaware Department of Justice, Fraud & Consumer Protection Division, New Castle County, reporting to the Director of the Office of Impact Litigation. The successful candidate will work with a small team of high functioning attorneys litigating important policy matters at the forefront of constitutional and administrative law (among other subject matters) in courts throughout the country.
This position will conduct work at the direction of the Department of Justice pursuant to the secondment agreement, but will be funded and employed as a fellow through the Progressive State Leaders Committee.  This is a one-year position that has the potential to continue after that year if funding remains available.

Responsibilities

This Special Deputy Attorney General will represent the Attorney General and the State in impact litigation work across a variety of subject matters in pursuit of policy priorities of the Attorney General. Matters to which the successful candidate may be assigned include multistate litigation in defense of constitutional rights of Delawareans, and the Attorney General’s litigation and investigations concerning the environment, firearms safety, federal rulemaking, healthcare, immigration, employee labor protections, and in protection of the rights of the beneficiaries of Delaware charitable entities. The Special Deputy Attorney General may also be tasked with pursuing other affirmative impact litigation work and investigations that could potentially lead to additional affirmative impact litigation work supporting the Attorney General’s policy priorities.
The Special Deputy Attorney General may also assist with the Attorney General’s work on amicus briefs, rulemaking comments, and position letters on all non-criminal matters, working with other Deputy Attorneys General and a Paralegal to track, review, and research incoming briefs, comments, and letters and prepare recommendations to the Attorney General whether to sign on to those briefs, comments, and letters. The Special Deputy Attorney General, as directed, may also participate in drafting amicus briefs, comments, and letters to emphasize and implement the Attorney General’s policy priorities.
The Special Deputy Attorney General may also be assigned to assist with the Attorney General’s charter revocation work, including coordination with the federal Office of Foreign Asset Control and the Delaware Division of Corporations.
The Special Deputy Attorney General reports to the Director of the Office of Impact Litigation with respect to all assigned work and may perform other duties as assigned.

Qualifications

Candidates must have very strong organizational skills, strong writing and presentation skills, be able to work independently and meet deadlines, and have a strong commitment to working in the public interest.  While we encourage attorneys with all levels of experience to apply, we will prefer candidates with a strong understanding of all facets of complex civil litigation, including a record of complex litigation experience in both federal and state courts.
