Case Description
State sought damages and injunctive relief, alleging that Defendant, M.D. Optical Co. established bylaws that set the prices for which ophthalmologists, optometrists and opticians sold their goods and provided their services. In order to resolve the dispute without further litigation, Defendant entered a consent decree, agreeing to refrain from restraining price competition and revising its bylaws accordingly. Additionally, Defendant agreed to pay a civil penalty to the State in the amount of $9000.
