Case Description

This settlement agreement was entered into by the State of Florida and Browning Ferris Industries, Inc. (BFI) as a supplement to the consented Final Judgment reached in United States, State of Florida, and State of Maryland v. Browning Ferris Industries, Inc. This settlement agreement addresses the collection and disposal of MedX’s or BFI’s Medical Waste, and addresses Residential Contracts with public entities. In addition to the settlement terms reached in the aforementioned case, in order to consummate the merger between BFI and Attwoods, PLC, BFI agreed to make its medical waste treatment facilities available to independent haulers of Medical Waste in the State of Florida. Further, BFI agreed that it would continue to operate the roll-off system for medical waste removal currently employed by MedX in Florida for a period of six months following BFI’s acquisition of Attwood’s stock. BFI agreed not to enforce noncompete clauses entered into between Attwoods and its employees once the employees had ceased receiving compensation from BFI or Attwoods. BFI further agreed to divest itself of the Residential Contract, subject to the approval of the City of Jacksonville, and to offer the Residential Contract for sale to qualified buyers. BFI also agreed to pay the State of Florida $50,000 in administrative costs and attorneys’ fees.
