State sought an injunction, alleging that Defendant, Alliance for Healthcare, Inc. conspired to interfere with free competition by entering into agreements with Alliance members to deal with third party payors on collectively determined terms. In order to resolve the dispute without further litigation, Defendant agreed by Consent Decree to refrain from acting on behalf of any Alliance member to negotiate with any third-party payor, and refrain from communicating that Alliance members will refuse to enter into or withdraw from any agreement, actual or proposed, with any third-party payor if any term or condition is not acceptable to Alliance or to Alliance members collectively.
