Case Description
This action was brought to block the sale of a graphite electrode plant in St. Mary’s, PA to one of the plant’s only two competitors. The sale was taking place in bankruptcy court. Shortly after the action was filed, the bankruptcy court awarded the plant to a new entrant as the best bidder because the sale to the other bidder, the competitor, would potentially be blocked by the antitrust action. The Commonwealth agreed to dismiss its complaint once the sale to the winning bidder closed.
