State sought damages and injunctive relief, alleging that Defendant Cemeteries were conspiring to fix the prices of burial services by refusing to provide the service on Sundays. Essentially, by refusing the Sunday service, citizens would have to take more time off work, it imposed extra eating and lodging expenses upon them, and the refusal resulted in increased costs for other businesses. The court agreed with the Plaintiff State, issuing a permanent injunction against refusing to provide burial services on Sundays. No damages or attorneys fees were awarded.
