Texas v. Mid-American Dairymen, Inc., Southern Foods Group, LP and Milk Products, L.L.C. , No. 9710120 (200th Dist. Ct. of Travis County, Sept. 3, 1997)

In separate suits, the State of Texas and the Department of Justice sued to enjoin Mid-American’s acquisition of Borden Holdings and subsequent divestiture of Borden-Meadow Gold, Inc. to Milk Products, LLC, alleging that the proposed transactions would substantially lessen competition in the milk processing and distribution industry in Texas. Both Texas and Department of Justice entered consent decrees, allowing transactions to proceed with certain restrictions concerning financing and future corporate connections. The defendants paid the state $30,000 in attorneys fees.
