Case Description

The State suit alleged that the San Antonio Alarm Association and some of its members entered into contracts, combinations, or conspiracies of the purpose of which was to discourage the entry of a new competitor, Diamond Security Systems, Inc. (a subsidiary of Diamond Shamrock, Inc.) into the business of selling, installing, servicing, and monitoring security alarm systems. The State also alleged that Defendant and its coconspirators furthered their unlawful agreements by organizing a group boycott of Diamond Shamrock, Inc. The substantial terms of these unlawful agreements were to collectively threaten to cancel and to cancel the conspirators’ gasoline accounts with Diamond Shamrock, Inc., to stop buying gasoline from Diamond Shamrock, Inc., and to inform Diamond Shamrock, Inc. that these actions were in response to the entry of Diamond Security Systems, Inc., into their market. The case settled with Defendants agreeing to an injunction and payment to State of $25,750 for attorney fees.
