Case Description
The United States and nine plaintiff states sued to block the $42 billion proposed merger between the Kroger company and Albertson’s companies, the country’s two largest traditional supermarket chain. The complaint alleges that the proposed acquisition may substantially lessen competition. The FTC began an administrative proceeding and the plaintiffs (states and FTC) sought a preliminary injunction to prevent the merger.
