Case Description
Plaintiff States sought an injunction, alleging that BFI’s hostile takeover of Attwoods would substantially reduce competition in the solid waste hauling market. In order to allow for the acquisition, BFI agreed to divest certain Attwoods assets in Florida and in Maryland in order to ensure a viable, competitive markets. Additionally, BFI agreed to shorten its contracts with small container customers to make it easier for potential competitors to gain access to the market in certain geographic areas. BFI also agreed to pay Florida and Maryland $50,000 each for costs of the investigation and attorneys fees. The Department of Justice also participated in the investigation.
