Defendants process raw milk and sell milk and related products. According to the state’s complaint, In the fall of 1986, the cospiracy created by the defendants resulted in price increases of 10 cents per gallon of milk.. The conspirators agreed to fix the price of wholesale dairy products and agreed upon a market allocation scheme to allocate the wholesale market for dairy products among them. Under the consdent decree agreed to by the parties, civiil penalties were assessed in the amount of $500,000 ($250,000 for each company). The parties also agreed to an injunction preventing any future agreements.
