Case Description
State sought damages and injunctive relief, alleging that Defendant health care providers conspired to fix the price for the delivery or sale of emergency medical services or other health care services. Further, the Plaintiff State alleged that Defendants allocated the markets for the sale of ambulatory surgery facility services, radiation facility services or other health care services. In order to resolve the dispute without further litigation, the parties entered a consent decree in which Defendants were enjoined from the alleged conduct and were required to pay $175,000 in civil penalties and $116,000 in costs and attorneys fees. Defendants were further required to provide $825,000 in free medical care and services.
