Case Description
Northwestern owned the only landfill within the competitive geographic area. It used the landfill to exercise or attempt to exercise monopoly control over the commercial trash hauling business. Northwestern also divided some of the commercial trash hauling market with another competitor. Under the settlement, Northwestern agreed to be non-discriminating in its use of dump fees at its landfill. Within a few years, the West Virginia Legislature authorized West Virginia’s Public Service Commission to rate regulate the dump fees, and they are now regulated by the Public Service Commission
