Bankruptcy Cases Filed by Tobacco Companies

Tobacco Center counsel have represented the states as counsel of record in litigation to protect states’ interests under the MSA and tobacco laws they enforce. They have served as counsel for the following bankruptcy cases:

  • In re: Alliance Tobacco Company, case no. 03-11030 (Bankr. W.D. KY)
  • In re: Carolina Tobacco Company, case no. 05-34156 (Bankr. D. Or.)
  • In re: Bekenton USA, Inc., case no. 05-60031 (Bankr. S.D. Fla.)
  • In re: M/S Dhanraj International, case no. 06-11593 (Bankr. C.D. Cal.)
  • In re Cutting Edge Enterprises, Inc., case no. 07-50585 (Bankr. W.D. NC)
  • In re: Liberty Brands, LLC, case no. 07-10645 (Bankr. D. Del.)
  • In re: House of Windsor, case no. 08-02944 (Bankr. M.D. Pa)
  • In re: Alternative Brands, Inc., case no. 09-50141 (Bankr. M.D. NC)
  • In re: CLP, Inc., case no. 09-03000 (Bankr. E.D. NC)
  • In re: International Tobacco Partners, LTD., case no. 10-74894 (Bankr. E.D. NY)
  • In re: Native Wholesale Supply Co., case no. 11-14009 (Bankr. W.D. NY)
  • In re: Prime Time International Co., case no. 2:14-bk-03518 (Bankr. D. AZ)
  • In re: Sandia Tobacco Manufacturers, Inc., case no. 16-12335 (Bankr. D. NM)
  • In re: Star Tobacco, Inc., case no. 16-12123 (Bankr. D. Del.)

Cases to enforce liens that secured a tobacco company’s Master Settlement Agreement payments:

  • Hauni Maschinenbau AG v. Vibo Corporation d/b/a General Tobacco, et al. case no. 10 CvS 1052 (Superior Court of Rockingham County, NC);
  • Focke & Co. GmbH v. Vibo Corporation d/b/a General Tobacco et al., case no. 11CVS 158 (Superior Court of Rockingham County, NC);

Case challenging the forfeiture of a tobacco company’s escrow fund account held for the benefit of the States in which it sold cigarettes:

  • U.S. v. Belcorp of America, Inc., et al., case no. 11CR000035 (W.D. VA)
